My Info Anywhere provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of the Site. This Privacy Policy applies to your access to and use of the Site, and by choosing to use them, you consent to the collection, transfer, processing, storage, disclosure and other uses of your information described in this Privacy Policy.

As used in this policy, the terms “using” and “processing” information include using cookies on a computer, subjecting the information to statistical or other analysis and using or handling information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within our organization or among our affiliates within the United States or internationally.

As used below, the term “Personal Information” is used to indicate any piece of information or data that can be used to identify any individual. Personal Information may relate to you as a Member, or it may relate to the individual that is the subject of any Profile that you create, if you create a Profile for a child, parent or other loved one.

We reserve the right, at our sole discretion, to modify this Privacy Policy, at any time and without prior notice. If we modify this Privacy Policy, we will post the modified Privacy Policy on the Site with or without prior notice of change. By continuing to access or use the Site, after we have posted a modified Privacy Policy or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Privacy Policy. If the modified Privacy Policy is not acceptable to you, your only recourse is to cease using the Site. Information we collect under the old Privacy Policy will remain subject to the old Privacy Policy unless and until you consent to the application of any modified Privacy Policy to such information. For purpose of the Privacy Policy, consent will be assumed without written non-contestation within two weeks of posting or notification of policy change.

You may browse the Site and download MIA App without expressly providing us any Personal Information that expressly identifies you, however, in order to make full use of MIA as made available via the Site, you will be required to register with us. When you register with us to create an account and become a Member, we will ask you for certain Personal Information. In order to set up your account, you need to provide your email address and you will need to select a password for more secure connections. We will also request a phone number for text messaging. If you elect to add any other Personal Information to your Account we will collect and store that information and use it and share it as set forth below.
As a Member, you will create a Profile and also enter personal information to be stored on the Site. The Profile may be personal to you and/or the Profile may include information for children, parents or other loved ones. You will be able to provide Personal Information about the individual that is to be stored in the Profile, whether yourself or your child, parent or other loved one. When you set up a Profile in MIA, we will collect and store any Information that you may elect to provide to us as part of the Profile Content, which may include but is not limited to gender, date of birth, personal contacts, photographs and files, insurance information, financial information and other Personal Information. In the event you include information that relates to someone other than yourself, you are solely responsible for ensuring that you have any and all consents and permissions to share that Personal Information with us and to use that information as part of MIA.
You may provide us with Personal Information of a third party, as contemplated by MIA Terms of Service, to access a Profile that you create. If you elect to invite any third party to access a Profile connected to your Account, we will ask you for such third party’s name and email address. We store this information for the sole purpose of access authorization to your Profile connected to your Account. The third party may contact us at support@myinfoanywhere.com to request that we remove this information from our database. We will contact the Account holder with notification of that request. that request.

We also collect the following information any time you visit the Site, as applicable. This information may not necessarily identify you, but if we have your Personal Information, or you otherwise set up an Account with us, we may link any of the below non-personal information with your Personal Information in our records.
Browser Log Data. When you visit the Site, whether as a Member or a non-registered user just browsing the Site, our servers automatically record information that your browser sends whenever you visit a website (“Browser Log Data”). This Browser Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, operating system or the webpage you were visiting before you came to our Site, pages of our Site that you visit, the time spent on those pages, access times and dates, and other statistics. We use this information to monitor and analyze use of the Site and for the Site’s technical administration, to increase our Site’s functionality and user-friendliness, and to better tailor it to our visitors’ needs. For example, we use this information to verify that visitors to the Site meet the criteria required to process their requests. We do not treat Browser Log Data as Personal Information or use it in association with other Personal Information, though we may aggregate, analyze and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information.
Cookies. The Site uses “cookies” to collect information. A cookie is a small data file that we transfer to your computer’s hard disk for record-keeping purposes. We use cookies for two purposes. First, we utilize persistent cookies to save your login information for future logins to the Site. App Usage Data. When you use the Site as a Member, our servers automatically record information that your mobile device sends whenever you use an Internet service. (“App Usage Data”). This App Usage Data may include information such as your computer’s IP address, device model and version, device identifier, operating system, time zone, name of your mobile operator or ISP, application performance measurements, and error conditions. It may also include a record of when specific features of the MIA App or MIA are used. We use this information to monitor and analyze use of the MIA App and MIA and for their technical administration, to increase their functionality and user-friendliness, and to better tailor them to our visitors’ needs. For example, we use this information to measure the popularity of different features and to more effectively resolve customer issues. We may aggregate, analyze and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information.
App Data. On mobile devices the Site downloads a copy of your data to your local device for storage to speed up the application and allow off line or emergency access when no network access is available. This App Usage Data includes information you enter and store in the Site. Data on your device is vulnerable without your devices protection. Ensure that you have enabled your mobile device with a password and where applicable have your device encrypt local storage as needed.

We do not sell or give away your Personal Information.
We may use any Personal Information in your Account as well as information in your Profile to provide the Site, complete your transactions, administer your inquiries, and present you with offers for products and services that we think may be of use or interest to you. We may contact you in various ways including but not limited to, via email, inside in the app, telephone, cell phone, and SMS/text messages. We do not charge communication fees, but your standard data/text rates apply.
We may aggregate and combine all Personal Information that we receive through your Member Accounts and your Profiles with the information of other Members and Profiles. We use this anonymous information to attempt to provide you with a better experience, to improve the quality and value of our services and to analyze and understand how the Site is used.

The Personal Information you enter and access through the Site as images and text are stored remotely and encrypted at rest and in transit to and from our servers. The site will encrypt and store your Personal Information data on our servers. The Site also will encrypt your Personal Information data during transfer. The Site will also backup and attempt to keep your Personal Information data accessible 24/7/365. A local copy of all your data is stored on your device and secured by the device's default operating system security. We encourage you to use a strong password on your device to prevent others from gaining access to your local data and also enable multi factor authentication via the settings. We also encourage you to monitor communications from us of account access and notify us of any unauthorized access to your account. All communications between the Site and a remote device are encrypted. Email messages and text messages are sent unencrypted. We strive to use the highest level encryption supported by your device. Data stored our servers is encrypted at rest using industry-standard PGP and HTTPS encryption. Security is also dependent upon you as a user of the Site. Do not disclose your personal account information to others, including your Member user name, password, or any other security credential you use to access your account. Use a secure password on your device and to access your data. We are not responsible for loss and/or theft of any data you enter. You personally take responsibility for data you enter on the Site and agree to hold blameless MIA and MAN Apps, LLC and all people associated with it for any data breach or loss.

Identity theft is of great concern to us. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your login information, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. We and the Site rely on the Internet and mobile networks, which are not always secure. the Site uses commercially reasonable efforts to maintain the confidentiality, availability and integrity of any information we collect, but we cannot assure that the use of the Site are secure or that your Personal Information or any other data that we may have will be secure. In the event we become aware of a security incident, we will notify you to the extent required under applicable law. The Site may contain links to other websites. If you choose to click on a third party link, you will be directed to that third party’s website. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you. Other websites follow different rules regarding the use or disclosure of the personal information you submit to them. When you register with us for access to MIA and successfully complete the account registration process you will become a “Member” of MIA. As a Member, you will have the opportunity to create one or more care profiles (“Profiles”) and to add information, data, and images to your Profile(s) (“Profile Content”). A Profile may relate to you or it may relate to your child, parent, or other person. We recommend that you protect the private and sensitive information contained within your Profile(s) and consider carefully whether to permit any Third-Party to access your Profiles. All Members are responsible for monitoring the Profile Content uploaded or added to their Profiles, whether uploaded by the Member or by a Third-Party.
If you are creating a profile on behalf of another person, by accepting these terms you attest that you are authorized by that person to create a profile on their behalf. To the extent you take action on behalf of the person you are creating a profile for, you also attest that you have valid legal authority to take that action on their behalf.
Please note that you, and not Us, are responsible for maintaining and protecting all Profile Content. We will not be liable to you for any loss or corruption of your Profile Content, or for any costs or expenses associated with backing up or restoring any of your Profile Content.

As long as your Member account is current, your Personal Information data is accessible through the Site on-line with network access, or off-line in emergency mode when on-line access is not available and/or desired. You as a Member or other authorized Third-Party users can only change, edit or delete Personal Information data when you are connected and logged in on-line through the Site. Personal Information data will not be synchronized in off-line mode. You can use as many devices as you wish with your account. Changes to one device will automatically sync to your other devices as you use them, upon each device being accessed through the on-line mode.
We reserve the right to delete your personal information and access if your account balance becomes overdue. We will make effort to inform you of the overdue account and make attempts to give proper warning before such data is purged from our system. Once purged, such data will not be restored upon activation or payment or back payment. Purged data will need to be reentered upon account reactivation.

If you breach any of these Terms, We have the right to suspend or disable your Account or terminate these Terms and disable access to your Profiles at its sole discretion and without prior notice to you. We reserve the right to revoke your access to and use of the Site at any time, with or without cause. You may cancel your Account at any time by sending an email to customerservice@myinfoanywhere.com. Upon receiving notice of cancellation we will delete your profile and entered data from our servers at which point the data will not be recoverable.

All sales are final, no refunds will be offered. Upon cancellation of your account, the account will remain active until the subscription expiration date.

You warrant and represent to Us that your use of the Site, whether as a Profile-creator or as a Third-Party, is solely for lawful purposes to facilitate the care of the individual that is the subject of the Profile. Neither Us, nor the Site, nor any Content, nor any Profile Content may be used in any instance for any unlawful purpose.

My Info Anywhere (“MIA”) is operated by MAN, LLC (“MAN” or “we”) and provides an online service to help organize, store, and manage your personal information through the MIA app and website, accessible at myinfoanywhere.com, or via applications for the iOS or Android operating systems (collectively, the “Site”) and our mobile applications (collectively, “MIA App”). THE SITE, MIA, MIA APP, AND MIA CONTENT ARE PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, MIA AND MAN EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. MIA and MAN MAKE NO WARRANTY THAT THE SITE, MIA, MIA APP OR MIA CONTENT WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. MIA AND MAN MAKE NO WARRANTY REGARDING THE QUALITY OF ANY SERVICES OR MIA CONTENT AVAILABLE FROM OR OBTAINED THROUGH THE SITE, MIA, OR MIA APP OR THE ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY MIA CONTENT OR PROFILE CONTENT OBTAINED THROUGH THE SITE, MIA, OR MIA APP. PROFILE CONTENT IS SUBMITTED SOLELY BY MEMBERS AND MIA AND MAN HAVE NO RESPONSIBILITY OR LIABILITY FOR THE TRUTHFULNESS OR ACCURACY OF THE SAME.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM MIA OR MAN OR THROUGH THE SITE, MIA OR MIA APP, WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
INDEMNITY
YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS MIA AND MAN, ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS, FROM AND AGAINST ANY CLAIMS, LIABILITIES, DAMAGES, LOSSES, AND EXPENSES, INCLUDING, WITHOUT LIMITATION, REASONABLE LEGAL AND ACCOUNTING FEES, ARISING OUT OF OR IN ANY WAY CONNECTED WITH (I) YOUR ACCESS TO OR USE OF THE SITE, MIA, MIA APP AND ANY MIA CONTENT OR ANY PROFILE CONTENT (WHETHER OR NOT IT IS A PROFILE YOU CREATED OR OTHERWISE), (II) ANY USE OF THE SITE, MIA OR THE MIA APP FOR ANY UNLAWFUL OR INAPPROPRIATE CONDUCT, OR (III) ANY ACT OR OMISSION BY YOU THAT CONSTITUTES AN ACTUAL OR ALLEGED VIOLATION OF THESE TERMS.
LIMITATION OF LIABILITY
YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, MIA, AND MIA APP, REMAINS WITH YOU. NEITHER MIA OR MAN NOR ANY OTHER PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SITE, MIA, OR MIA APP WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SITE, MIA, OR MIA APP OR THE INABILITY TO USE OR ACCESS A PROFILE OR ANY SPECIFIC PROFILE CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT MIA OR MAN HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
IN NO EVENT WILL MIA OR MAN’S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SITE, MIA OR MIA APP EXCEED THE AMOUNTS YOU HAVE PAID TO MIA OR MAN FOR USE OF THE SAME, IF YOU HAVE MADE ANY PAYMENTS TO MIA OR MAN FOR USE OF THE SAME OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN MIA, MAN AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
